Class action lawsuit buyback program

Previous system failed due to glaring design flaw. That system had a lifetime warranty on both parts and labor, but Carrier would reimburse dealers a fraction of the cost required to perform the repair making the warranty useless. This resulted in a class action lawsuit that resulted in the buy back program. The details of this buy back seem to be somewhat murky since I could only find one dealer in my area who had any knowledge of this program. I had multiple dealers recommended by Carrier who did not know about the buy back program who told me that they could find no information about it when contacting Carrier. The class action lawsuit was over the secondary heat exchanger. The design of the exchanger as explained to me by the Carrier reps was steel heat exchanger that had a plastic cladding. The TCE (Thermal Coefficient of Expansion) for steel and plastic are vastly different, which means this design was doomed to fail when the plastic cladding inevitably debonded from the steel part of the heat exchanger. The lifetime warranty played a large role in our decision to purchase the previous Carrier system and we were very disappointed that Carrier failed to honor that warranty. Even with the buy back program we had seen a lot of money for the replacement system, we have zero faith in the warranty on the new system. The new system has a higher level of integration which means repairs will be more expensive and the variable burner is new technology which will also be expensive to replace if/when it fails. The installation was a nightmare, it took a very long time we were without heat for over a month in the winter and the installation still isn’t right. This is a high efficiency unit which is supposed to burn outside air, but since all the Carrier dealers in our area do not have insurance for their techs to be able to go on the roof, we were forced to reduce the efficiency of the furnace by burning inside air. The other issue just discovered at a filter change is that when the new furnace was installed, the A/C coils above it was not installed correctly causing condensed water to drip on the filter. If we had to do this again we’d definitely go with a std efficiency system for easier installation and lower cost and we would have to consider other brands as well. In this climate the higher efficiency does not make up the increased cost of the furnace.

The only thing I have gained as a new carrier customer is noise level/comfort is lower than old trane system. Electric use on the heat pump is sightly higher than old system.

1. To the original owner on eligible equipment for eligible residential applications. Warranty period is 5 years if not registered within 90 days. Jurisdictions where warranty benefits cannot be conditioned on registration will automatically receive a 10-year parts limited warranty, which can be changed to the 5-year parts, plus a 3-year labor option on eligible equipment within the first 90 days after installation. The 5-year parts, plus 3-year labor warranty option is available only if the installing dealer/contractor has elected to participate in the Consumer Choice warranty program and has accepted the Consumer Choice dealer terms and conditions.

This furnace does not comply with SCAQMD Rule 1111 or SJVAPCD Rule 4905, which places a NOx emission limit of 14 ng/J. Therefore, this unit is not eligible to be installed in the South Coast Air Quality Management District (SCAQMD) nor the San Joaquin Valley Air Pollution Control District (SJVAPCD).
